Georgia's Dog Bite Statute

Under OCGA 51-2-7, a dog owner who owns or keeps a vicious or dangerous animal, and who by careless management or by allowing the animal to roam freely, causes injury to another person may be liable for damages to the injured victim.

In proving the dog's vicious propensity, it shall be sufficient to show that the dog was required to be at heel or on a leash by a city or county ordinance, and that the dog was not at heel or on a leash.

For a dog owner to be found liable for damages, the victim must prove:

  • The dog was dangerous or vicious; and
  • That the dog's owner had knowledge that the dog was vicious; and
  • The dog's owner either carelessly managed the dog, or allowed the dog to go at liberty.

Otherwise, the plaintiff must prove that the dog was not at heel or on a leash as required by law, and that the defendant carelessly managed the dog, or allowed the dog to roam freely.
